1 Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and GiftyView ("Company", "we", "us", or "our"). By downloading, installing, or using the GiftyView mobile application or website (collectively, the "Services"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use our Services.

2 Eligibility

To use GiftyView, you must meet the following requirements:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract under Nigerian law
• Not be barred from using financial services under applicable law
• Provide accurate and complete registration information
• Have a valid Nigerian bank account (required for wallet withdrawals)

By creating an account, you represent and warrant that you meet all eligibility requirements. GiftyView reserves the right to refuse service to anyone at any time.

3 Account Registration

You are responsible for maintaining the confidentiality of your account credentials. Specifically:

• You must provide accurate, current, and complete information during registration
• You are responsible for all activity that occurs under your account
• You must notify us immediately at security@giftyview.com of any unauthorized access to your account
• You may not share your account credentials with any third party
• You may not create multiple accounts — one account per person is permitted
• You must complete identity verification (KYC) to unlock full transaction limits

4 Our Services

GiftyView provides the following financial technology services:

• Digital Wallet: A Nigerian Naira (NGN) wallet for storing funds, making payments, and receiving proceeds from gift card sales
• Gift Card Trading: Buying and selling of digital and physical gift cards at published exchange rates
• Bill Payments: Payment of utility bills including airtime, mobile data, electricity, cable TV, internet subscriptions, and betting wallet top-ups
• Transaction History: Access to a complete history of all transactions performed through the platform

We reserve the right to modify, suspend, or discontinue any feature or service at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of services.

5 Gift Card Trading Rules

The following rules apply to all gift card transactions on GiftyView:

• Authenticity: You warrant that all gift cards you submit for sale are authentic, unused, not expired, and legally obtained. Submitting stolen, counterfeit, or fraudulently obtained gift cards is a criminal offence and will result in immediate account termination and reporting to law enforcement.
• Rates: Exchange rates are dynamic and set by GiftyView at our sole discretion. The rate displayed at the time of submission is the rate that will be applied to your transaction.
• Verification Period: All sold gift cards are subject to a verification period of up to 24 hours. Payment is credited to your wallet only upon successful verification by our team.
• Declinations: If a card is declined, you will be notified with a reason. GiftyView's decision on card verification is final.
• Image Quality: You must upload clear, unobstructed images of the gift card front and back. Blurry, cropped, or tampered images will result in rejection.
• Digital Cards: For digital gift cards, the card code and PIN you provide must be accurate. Submission of incorrect codes will result in rejection.
• No Chargebacks: Once a gift card has been approved and your wallet credited, the transaction is final and cannot be reversed.

6 Wallet & Payments

• Funding: You may fund your wallet via bank transfer, debit card, or USSD. Funds are credited upon confirmation by our payment processor.
• Withdrawals: Withdrawals are processed to verified Nigerian bank accounts only. Withdrawals are subject to identity verification and may be delayed for fraud review.
• Transaction Limits: Unverified accounts (KYC Level 0) have a daily transaction limit of ₦50,000. Limits increase with KYC verification level.
• Dormancy: Accounts with no activity for 12 months may be classified as dormant. Dormant account balances are held in trust and are fully retrievable upon reactivation.
• Frozen Accounts: We may freeze your wallet if we suspect fraudulent activity, pending investigation. Frozen wallets cannot send or receive funds until the investigation is resolved.
• No Interest: GiftyView does not pay interest on wallet balances. Your wallet is a transaction account, not a savings account.

7 Bill Payments

• Accuracy: You are solely responsible for entering correct beneficiary details (phone number, meter number, smart card number). Payments made to incorrect beneficiaries cannot be reversed.
• Processing Time: Most bill payments are processed within seconds. Electricity token delivery may take up to 5 minutes during peak periods.
• Provider Outages: GiftyView is not responsible for delays caused by third-party utility providers or network operators. In the event of a failed payment due to provider issues, your wallet will be automatically refunded within 24 hours.
• Minimum Amounts: Minimum payment amounts are set by individual service providers and may vary.

8 Fees & Charges

The following fees apply to GiftyView transactions:

• Wallet Funding (Bank Transfer): Free
• Wallet Funding (Debit Card): 1.4% of transaction amount, capped at ₦2,000
• Wallet Withdrawal: ₦50 flat fee per withdrawal
• Airtime & Data: No additional fees (margin included in pricing)
• Electricity & Cable TV: No additional fees
• Gift Card Sell: No explicit fee — our margin is built into the exchange rate
• Gift Card Buy: No additional fees

GiftyView reserves the right to introduce, modify, or waive fees at any time. Changes to fees will be communicated at least 7 days in advance via in-app notification.

9 Prohibited Activities

The following activities are strictly prohibited on GiftyView:

• Using the platform for money laundering, terrorist financing, or any illegal financial activity
• Submitting stolen, counterfeit, or fraudulently obtained gift cards
• Creating multiple accounts or impersonating another person
• Attempting to hack, reverse-engineer, or exploit any part of the GiftyView system
• Using automated bots, scrapers, or scripts to access the platform
• Sharing, selling, or transferring your account to another person
• Using the platform to process payments for illegal goods or services
• Abusing the customer support system with false claims or chargebacks
• Attempting to circumvent transaction limits or security controls
• Engaging in any activity that could damage GiftyView's reputation or operations

Violation of these prohibitions may result in immediate account suspension or termination, forfeiture of wallet balance where permitted by law, and referral to Nigerian law enforcement agencies.

10 Intellectual Property

All content, features, and functionality of GiftyView — including but not limited to the app design, logo, text, graphics, icons, and software — are owned by GiftyView and are protected by Nigerian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the GiftyView application solely for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our services or software.

11 Disclaimers

GiftyView's services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Uninterrupted, error-free, or completely secure operation of the platform
• Accuracy of exchange rates or availability of specific gift card brands
• Continuous availability of third-party services (payment gateways, utility providers)

Exchange rates are indicative and may change between the time of display and transaction completion. We are not liable for losses arising from rate fluctuations.

12 Limitation of Liability

To the maximum extent permitted by applicable Nigerian law, GiftyView shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Losses arising from unauthorized account access caused by your failure to secure your credentials
• Losses due to incorrect beneficiary details entered by you during bill payments
• Losses caused by third-party service outages (payment processors, utility providers)

Our total liability to you for any claim arising from or related to these Terms or our Services shall not exceed the amount you paid to us in the 30 days prior to the claim arising.

13 Termination

By You: You may close your account at any time by contacting support@giftyview.com. Any wallet balance above ₦100 will be transferred to your registered bank account within 5 business days after deducting any outstanding fees.

By Us: GiftyView may suspend or terminate your account immediately, without prior notice or liability, for any of the following reasons:

• Violation of these Terms of Service
• Suspected fraudulent, deceptive, or illegal activity
• Failure to complete required identity verification within 30 days
• Extended account inactivity (2+ years with zero balance)

Upon termination for cause, GiftyView may withhold wallet funds pending fraud investigation. Funds not associated with fraudulent activity will be returned after investigation.

14 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Lagos, Nigeria, under the Lagos State Arbitration Law 2009 or any successor legislation.

Nothing in this clause prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction in Nigeria.

15 Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• We will update the "Last Updated" date at the top of this page
• We will send an in-app notification to all registered users
• We will email registered users at least 7 days before changes take effect

Your continued use of GiftyView after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services and may close your account.
